TERMS AND CONDITIONS OF THE VALENTINE’S DAY 2014 ONLINE CONTEST NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THE CONTEST.
- Entry is open to anyone aged 18 or over, with the exception of (i) our employees and those of our affiliates, as well as any relatives of such employees and (ii) residents of France and Italy, for whom separate rules apply as available at www.sweetlove.swatch.fr and www.sweetlove.swatch.it, respectively.
- Only one entry per person will be accepted; multiple or automated entries or entries through agencies are not allowed. In the event of a dispute as to a person’s identity, the entry will be deemed to have been made by the holder of the email account or street address associated with it.
- To enter, you must fill out the form on www.sweetlove.swatch.com and upload a customized picture of yourself to the said website.
- The provision of any invalid, incorrect, or misleading personal information may result in disqualification from the Contest and/or receipt of a prize. Moreover, we reserve the right to disqualify any individual we find to be tampering with the entry process, acting in an otherwise disruptive manner, or violating the Rules.
- You agree that your picture may be viewed by other Internet users, in particular by other entrants and our Facebook fans, and warrant that it will not be offensive, explicit, or otherwise inappropriate. We may remove any picture we determine, in our sole discretion, to be inappropriate and disqualify the entrant who uploaded it from the Contest.
- You further warrant that you are allowed to upload your picture and that it does not infringe any copyrights, trademark rights, or other rights or laws. We disclaim all liability for the uploaded picture to the greatest extent legally permissible. You agree to indemnify and hold us harmless against any liabilities, claims, actions, damages, losses, and costs arising in this connection.
- You agree that we may reveal your full name, country of residence, and picture in any of our publications, including both print and Internet media (e.g., Facebook, Instagram, and Twitter).
- Incomplete or otherwise faulty entries will not be accepted. We reserve the right to determine, in our sole discretion, if an entry is valid. To the greatest extent legally permissible, we disclaim all liability for entries that are faulty, lost, misdirected, delayed, or corrupted, for technical reasons or otherwise.
- The Contest will begin on January 14, 2014 and end on February 10, 2014.
- Out of all the uploaded pictures, ten winning ones will be selected via an equal combination of votes from the entrants and our discretion. Out of the ten winning pictures, we will then select the most creative one as the overall winner.
- The ten winners will be announced and notified by email on February 14, 2014. If a winner cannot be reached or does not reply to the prize notification within 72 hours, the prize will be assumed to have been forfeited and will be awarded to another entrant.
- The overall winner will win a travel voucher worth 2,000 euros and one Swatch Valentine’s Day 2014 watch. He alone will be responsible for providing any documents necessary to redeem the travel voucher, such as a visa and/or passport. If he is unable to do so, we reserve the right to award the prize to one of the other nine winners.
- The remaining nine winners will each win one Swatch Valentine’s Day 2014 watch.
- We reserve the right to select an alternative winner if a winner is in breach of the Rules.
- To claim a prize, all ten winners will be required to prove their age and identity by submitting documents to that effect (e.g., an ID card or passport).
- The right to claim a prize is nontransferable. No cash alternatives or alternative prizes are available. However, we reserve the right, in our sole discretion, to substitute any prize with an item of equal value.
- The winners will bear any taxes and/or levies due on the prizes.
- Any decisions by us regarding the Contest are final and no correspondence will be entered into.
- To the greatest extent legally permissible, we disclaim all liability for any damage, loss, or disappointment suffered by any person taking part, or suffered as a result of not being able to take part, in the Contest.
- We reserve the right to amend the Rules at any time and to modify, suspend, or terminate the Contest in the event it becomes infected by a computer virus or becomes otherwise technically impaired.
- The Rules are governed by and will be construed in accordance with Swiss law. Any disputes relating to the Rules must, in the absence of an amicable settlement, be brought exclusively before a court of competent jurisdiction in Biel/Bienne, Switzerland.
- The Contest is void where prohibited by law.
